SEXUAL HARASSMENT COMMITTEE (SHC)- POLICY
In compliance with the instructions of National Commission for women and guidelines issued in implementation of the directives of Hon’ble Supreme Court Judgement dated 13th August, 1997 in the case of Visakha and others vs. State of Rajasthan and Others on the subject of sexual harassment of women in the workplace, the Maharaja Agrasen Institute of Management Studies (MAIMS) has duly constituted an Internal Complaint Committee for considering complaints of sexual harassment of women working in all the Departments of MAIMS.
QUORUM
The quorum for the meeting shall be three at least including Chairperson/convenor of ICC. The ICC shall assure that the complaint should be properly resolved in a stipulated time limit provided by the committee
INTERNAL COMPLAINT COMMITTEE (ICC) POLICY

workplace, the Maharaja Agrasen Institute of Management Studies (MAIMS) has duly constituted an Internal Complaint Committee for considering complaints of sexual harassment of women working in all the Departments of MAIMS.
OBJECTIVES
The objectives of the ICC to Prevent Sexual Harassment of Women at the Workplace are as follows:
- To develop a policy against sexual harassment of women at MAIMS.
- To ensure the implementation of the policy in letter and spirit through proper reporting of the complaints and their follow-up procedures.
- To uphold the commitment of the Institute to provide an environment free of gender-based discrimination.
- To promote a social and psychological environment to raise awareness on sexual harassment in its various forms.
- To create a secure physical and social environment to deter any act of sexual harassment.
- To evolve a mechanism for the prevention and redressal of sexual harassment cases.
FUNCTIONS
- Redressal of complaints within the scope of the laws, with fairness and without bias and within the time period of 90 days.
- To organize workshops for employees to educate all employees of the institute about Sexual harassment at the workplace, its effects, and laws against it,
- To show documentary films on Sexual Harassment to the employees of MAIMS.
- To apprise about the filing of a complaint with the ICC and the role of RTF.
- Recommend interim measures as needed (mainly for the complainant) to conduct a fair inquiry.
- The mechanism for registering complaints should be safe and accessible.
PROCEDURE
Complaints regarding Sexual Harassment against women can be made either in paper form or by sending e-mail to icc@maims.ac.in. An aggrieved woman can make a written complaint of sexual harassment at workplace to the ICC (in case a complaint is against the employer), within a period of three months from the date of incident and in case of a series of incidents, within a period of three months from the date of last incident. As per the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Rules, 2013, in case the aggrieved woman is unable to make a complaint on account of her physical incapacity, a complaint may be filed inter alia by her relative or friend or her co-worker or an officer of the National Commission for Woman or State Women's Commission or any person who has knowledge of the incident, with the written consent of the aggrieved woman. The Role of Rapid task force (RTF) is to examine the situation with a view to assess short coming both at the level of gender sensitization and sexual harassment related redressal systems and to suggest measures, recommendations for improvement to the justice system and protection of rights for both the victim and the accuse. The constitution of RTF is to explore the current situation prevailing in campus in relation to safety of women and youth.
- A complainant may appear in person to present his case.
The ICC shall be guided by the principles of natural justice. The Internal Complaint Committee shall ensure the disposal of every application as speedily as possible.
This will be forwarded to the senior faculty mainly women in charge. This will be again forwarded to RTF for verification of incident & enquiry.
RTF will submit the report within 7 days and give feedback to the complainant
This will be again forwarded to Action in-charge committee and reports will be submitted to the final authority, the director
On the conclusion of proceedings, the ICC shall pass such order with reasons, as may be deemed fit to redress the grievance and provide such
reliefs that may be desirable to the affected party at issue.
EXCLUSIONS:
- The committee is NOT to act as moral police; neither will it intrude on anyone’s privacy.
- The role of the Committee is to create awareness about sexual harassment and to deal with and recommend punishment for non-consensual acts of sexual harassment, but at the same time not to curtail sexual expression within the campus.
- The ICC will not insist on a graphic description of the sexual harassment.
- The ICC shall ensure confidentiality while dealing with the matter.
